Restructuring
Our corporate restructuring team combines the firm’s corporate, financial planning, funds, and regulatory experience with extensive knowledge in insolvency. Most insolvencies and restructuring span various jurisdictions. With our understanding of local markets, insolvency laws and processes in the major financial jurisdictions we are able to deal with most complex cross-border and conflict of law issues.
We assist in every aspect of the process, from the choice of business entity and the organizational requirements required, through to complicated group reorganizations and demergers.
Insolvency
In the UK, we have long experience of dealing with English insolvency law and procedure, including acting in liquidations, administrations, administrative and other receiverships as well as personal insolvency. This includes advising in relation to the duties which arise during what is sometimes called the "twilight zone" between the time an entity becomes technically insolvent and the commencement of the formal insolvency procedure. In this respect, we also advise directors on their duties (and personal risks) during this uncertain period. Our advice covers cross-border fraud and asset-tracing, as well as arranging for the cooperation of the English court over letters of request received from courts of other jurisdictions.
