Our commercial litigation practice assists clients who have been negligently advised by their professional advisers - lawyers, accountants, tax advisers, investment advisers, surveyors and others.

When dealing with negligence cases in these fields, we benefit from the knowledge and experience of our tax, trusts, estates and charities lawyers.

At the request of their insurers, we also act for barristers and solicitors who have been sued for negligence. Because we defend negligence claims, as well pursuing others, we benefit from insights gained on both sides of the table.

We represent many charities who have been poorly advised over probate and trust issues; for example, we help them recover funds where inheritance tax has been misallocated or assets have not been properly realized after the grant of probate.

  • Acting for Bar Mutual in a number of cases defending barristers whose advice is alleged to have been negligent.
  • Successfully representing the former client of a firm of solicitors who had been given inappropriate advice. regarding the setting up of an employee benefit trust
  • Acting for Rev Cathy Horton in her successful negligence case against Lloyds Pharmacy Ltd, who dispensed a dangerously high level of medication to her without double-checking the level with the prescribing doctor.
  • Acting for charities in a matter where the solicitors administering the estate for a trust company conveyed land but failed to preserve the estate's share and development uplift worth in excess of £500,000.
