Acquisitions & disposals

Transactions involving valuable artworks may require considerable legal input, especially where there is an international element.

Our team's experience means that we provide a very practical service. We carry out due diligence, advise buyers on how to structure the transactions to minimize tax, as well as drawing up contracts and negotiating with the seller. We can also help with insurance, shipping, import and export considerations, tax and after-sale warranties, and set up escrow arrangements so that the transaction can be completed. Additionally, we are able to guide buyers concerned about copyright and resale rights.

We also advise sellers, often on insurance-related issues and taxation. If the sale is by auction, we negotiate the contract with the auction house, as well as auction guarantees and advances over sale proceeds. If it is a private sale, we draft the sales contract and negotiate with the buyer.
