Our team has a wealth of experience acting for clients on all aspects of the law relating to copyright and designs.

Part of our work focuses on advice regarding the opportunities for commercial exploitation of copyright works and designs: specifically, we act for a number of leading fashion designers on the commercial exploitation of their collections.

We are also involved with protecting and enforcing copyright, via court proceedings, trading standards and commercial channels. Members of the team have acted extensively in copyright and design right infringement proceedings for a wide variety of clients, including members of the fashion industry, advertising and design agencies, computer software companies and manufacturers.

Recent work 

  • Acting for Società Esplosivi Industriali SpA in a long-running design right case involving multiple warhead systems. The case was notable as the Court, for the first time, had to assess the impact of the alleged infringers' mental capacity in deciding whether the alleged acts amounted to infringements under the wording of the relevant legislation.
  • Advising a leading charity in relation to its ownership of the copyright in a well-known play.
  • Advising Handi-Craft Company and New Vent Designs Inc, the manufacturers of Dr Brown's anti-colic baby feeding bottle, on the design right and copyright aspects of an infringement action. Infringement of their patent and trade mark was also involved.
  • Advising a manufacturer of electrical machinery in relation to infringement of copyright and trade mark and in relation to passing off.
  • Successful defense of a copyright infringement claim asserted against an internationally-recognized jazz musician, arising from his preparation of a musical score for the feature and silent film presentations focusing on the life of the father of jazz, Buddy Bolden.
