Cross-border disputes (forum shopping)

'Forum shopping' – choosing a jurisdiction in which to make a financial claim - may be an option for the growing number of wealthy couples who have different nationalities or divide their time between different countries.

The right choice of country for a client can have a significant impact on the size of a divorce settlement. Rules regarding which assets are eligible for inclusion in the divorce settlement, disclosure requirements or the rules regarding maintenance, vary from country to country.

Our skill lies in identifying the best jurisdiction for particular clients at the earliest stage, and in ensuring that their worldwide assets are protected or that a financial claim is pursued vigorously. Our knowledge of complex tax issues, together with the firm's experience in setting up, administering and dismantling trusts, means we can offer clients a complete service in the resolution of their forum disputes.

Eleven members of our team are Fellows of the International Academy of Matrimonial Lawyers; the largest IAML membership of any UK firm. Consequently, over the years, we have established strong relationships with many foreign lawyers abroad and we are well-placed to assist clients in co-ordinating international advice to identify at an early stage the most appropriate jurisdiction for their case.
