Intellectual property

For any brand, intellectual property is the foundation on which the success of the business is built. Protection of the key concept - whether it is a mark, an invention or a specific design - is paramount to the growth of the brand's value. Our brands practice is highly experienced in advising luxury and consumer brand owners and designers on the creation, registration and maintenance of trade marks, patents, designs and copyright. More generally, we regularly assist clients on brand strategy and portfolio protection and enhancement, both at a domestic level and internationally.

On occasion it becomes necessary for clients to take action to defend their intellectual property. We have advised luxury and consumer goods companies in a number of contentious contexts - for example, on the creation of an anti-counterfeiting strategy, and on letters sent prior to legal action requiring goods to be withdrawn from sale, followed by eventual litigation. We also assist clients wishing to take action against the media to prevent damaging stories being published or broadcast or take action following adverse coverage seeking damages, corrections and apologies.
