Court of Protection

We regularly advise clients on a wide range of issues involving the Court of Protection, both non-contentious and contentious.

Working in close conjunction with colleagues in our wealth planning and probate and trust management teams, we provide guidance on statutory wills, lifetime gifts and deeds of variation of estates which require an application to the court.

We try to avoid litigation but if it is in our clients’ best interests we have considerable experience in contested Court of Protection hearings, both bringing applications, for example for contentious statutory wills or to register enduring powers in a contentious context, and oppose applications which would disadvantage clients.

Recent work 

  • Successfully acting on behalf of a family member in an application to replace a professional receiver. It is unusual for such an application to succeed.
  • Acting for a number of charities successfully challenging proposed statutory Wills which would reduce their entitlement.
  • Acting for a group of family members who were potentially disadvantaged under a proposed statutory gift and Will resulting in a successful settlement worth several millions.
