Our elder law practice has worked with government on legislation to protect older clients and their families or carers. An important element of our work involves advice relating to the grant and operation of powers of attorney. Enduring and Lasting Powers of Attorney enable elderly people to appoint another person to manage their financial affairs with immediate effect or in the future. Members of our elder law practice took a lead role in consulting with legislators over new UK Lasting Power of Attorney, which replaced Enduring Powers in October 2007. This work included reviewing and commenting on the then Lasting Power of Attorney forms at the request of the Public Guardianship Office. Members of the team have been involved in the 2008 review of the forms as well.

With a broad UK and international client base, we regularly give clients guidance on the effectiveness of UK powers of attorney abroad, and of foreign powers of attorney in the UK.
We are also strongly placed to provide advice to either party when disputes arise over powers of attorney. We act for attorneys, deputies and others in making applications to the Court of Protection, and also in defending actions brought against them. We also act for elderly clients who have granted powers of attorney (and other family members affected) in relation to actions taken by attorneys.
