Powers of attorney

Our elder law practice has worked with government on legislation to protect older clients and their families or carers.  An important element of our work involves advice relating to the grant and operation of powers of attorney.  Enduring and Lasting Powers of Attorney enable elderly people to appoint another person to manage their financial affairs with immediate effect or in the future.

Members of our elder law practice took a lead role in consulting with legislators over new UK Lasting Power of Attorney, which replaced Enduring Powers in October 2007.  This work included reviewing and commenting on the then Lasting Power of Attorney forms at the request of the Public Guardianship Office.  Members of the team have been involved in the 2008 review of the forms as well.

Recent work 

  • Advice to a client who wished to provide in his power of attorney for an independent audit of the attorney's financial accounting.
  • Advice on the use of powers of attorney in relation to property in Spain and obtaining a Court of Protection order to authorise.
  • A successful challenge by one sibling to the registration of an enduring power in favour of another sibling and a consequent order that an independent professional be appointed receiver in the circumstances of the breakdown of family relationships.
  • Advising individuals in relation to a new type of power of attorney - Lasting Powers of Attorney both for financial and welfare matters - which was introduced into UK law from 1 October 2007.
