Inheritance Act claims

Our London office has considerable practical knowledge of representing clients in claims under the Inheritance (Provision for Family and Dependants) Act 1975.

We act both for individual claimants seeking a greater share of the disputed estate, and for beneficiaries - often charities who rely on legacy income - who are defending their interest in it. Whichever side we represent, we work to achieve a mediated settlement out of court where possible.

Our client list in bringing these claims extends to a broad range of individuals. In defending claims, our experience is built around our charity client base: we represent organizations such as the RSPCA, Cancer Research UK and the Salvation Army, which regularly face attacks from individuals claiming under the 1975 Act.

Recent work

  •  March 2008 - Bowen v Garrity and others secured dismissal through negotiation of a combined 1975 Act and validity challenge.
    December 2007 - mediated dispute on behalf of national charities resolution of a widow's 1975 Act claim issued in the Bournemouth County Court.
    November 2007 - successfully defended charities' entitlement to the residuary estate in reponse to an adult child 1975 Act claim in Hereford County Court.
  • Acting for nine charities in a five-handed mediated settlement involving children's interests, in Prigmore & Another v Seckington & Others.
  • Representing the claimant in the first big-money widow's claim on the 1975 Act since 2000.
