Restructuring of trusts

In the UK, we frequently make applications to the English court to restructure trusts, using the court's powers under the Variation of Trusts Act 1958 or the Trustee Act 1925. We have made similar applications in a number of offshore jurisdictions and in a number of US states.

These changes to a trust's structure may be requested for tax, family or other reasons.

Our client base comprises high net worth families who are beneficiaries of trust structures that extend across the world. We also act for trustees, both individual and corporate, in the restructuring of the trusts themselves, and also of the underlying assets that often make up the bulk of the family's wealth.

Recent work

  • Representing a high net worth family who needed to restructure a trust in order to deal with issues that had arisen as a result of the 2006 Finance Act.
  • Acting for a well-known family in restructuring trusts in an offshore jurisdiction, involving hundreds of millions of US dollars' worth of assets.
  • Acting for trustees of a trust established by statute in obtaining court approval so as to enable the trustees to undertake commercial borrowings to redevelop a racecourse.
