Services for public charities, private foundations and museums

We have represented several of the New York and UK art museums and galleries, including the National Gallery and the four Tate galleries. We also act for a number of private museums, art galleries and foundations, both in the US and the UK.

Our advice ranges from charity law, trust law and governance issues, to taxation and gift aid, acquisitions and co-ownership arrangements with other museums, exploitation of intellectual property rights, legacies, commercial contract work, fundraising and sponsorship. We also have a team dedicated to advising on data protection issues.

Philanthropists are understandably always looking to structure their support of the arts in tax-efficient ways. Our team helps clients find appropriate ways of using their wealth philanthropically, reflecting their personal interests, goals, circumstances and how they would like the world to view their collections while also reducing tax exposure. This can involve supporting an existing charity or, in some cases, establishing a new one. In some cases, clients will wish to support existing charitable entities; in other circumstances, establishing a new charitable foundation may be the preferred way of furthering individual philanthropic aims.

We assist clients in setting up US qualified, UK qualified and dual UK/US qualified charitable structures to support the arts all over the world. We have pioneered use of the dual US/UK structure to ensure tax efficient gifting by US individuals resident in the UK. We also advise on ongoing compliance and operation, including the most efficient ways to involve other family members in the charity.
