The onset of the CISG in Hong Kong and recent developments in international trade law worldwide

On 1 December 2022, the United Nations Convention on Contracts for the International Sale of Goods Act (“CISG”) will take effect in Hong Kong, bringing a set of unified rules for international commercial transactions and eliminating any doubt of whether the CISG applies in Hong Kong. The implementation of the CISG in Hong Kong will enable local businesses to trade with their overseas counterparts using a sales law that both sides are familiar with. More than 20 of Hong Kong’s largest international trade partners are contracting states to the CISG. For parties who have not considered or included specific provisions to govern their contractual relationships, the application of the CISG may also provide a safety net to protect parties’ interests.
