Probate dispute and challenge to lifetime property transfer

Marcus Flavin of Radcliffe Chambers represented the son (and grandson) of the late Mrs Chin. They took the entire estate to the total exclusion of Mrs Chin’s five daughters.

The five day trial centred on a will which the daughters challenged on the grounds of want of knowledge and approval and undue influence, and on the transfer of a property to the grandson which the daughters challenged on the grounds of undue influence.

Mr Flavin will discuss the legal principles and their application by the judge in this instance and lessons to be learned in bringing or defending these claims.
