Patrick Hamlin

Patrick is of counsel in the trust and succession disputes team.

He focuses on trust and succession litigation including Inheritance Ordinance claims, breach of trust actions and applications for construction of trust documents and wills. He also advises on removal of personal representatives and trustees.

Patrick gives advice on all types of charity litigation, as well as fraud and asset tracing. He has a particular interest in SE Asia, having practised in Hong Kong for 22 years.

My broad experience has given me an insight into the 'can do' entrepreneurial culture that drives Hong Kong.

I arrived in Hong Kong in 1979 and after four years in private practice, I was appointed a Crown Counsel in the Attorney General’s Chambers of the Hong Kong Government. In 1991 I became Deputy Crown Solicitor and Head of Litigation so I was responsible for all litigation by and against the Government in the courts and tribunals of Hong Kong. About that time I was also involved in the arrangements for the return of Hong Kong to China in 1997.

In 1994 I returned to the UK and joined the Treasury Solicitors Department where I was Senior Lawyer representing the Department of Trade and Industry and its agencies (1995-1996) and then Head of Chancery Litigation (1996-1999) where I represented the Attorney General, Charity Commission, HM Land Registry, the Official Solicitor, Court of Protection and other public bodies. I then became part of Withers Contentious Trust and Succession Group in London and transferred back to Hong Kong in 2010 to launch the litigation practice here.

I have been fortunate to have had such a broad experience over many years in both Hong Kong and London. This has given me an insight into the ‘can do’ entrepreneurial culture that drives Hong Kong as the region’s leading international city.
