Elder law

As life expectancy increases, elder law is becoming both more important and more complex. We are pioneers in this field and are proud to have published academics on our team who have helped to shape the law.

We encourage all our clients to consider the possibility of mental and/or physical decline when planning their estates. We can help them to select a suitable attorney to make decisions if they become incapacitated, define that person’s role and build in safeguards where appropriate.
In cases where no provision has been made, we advise relatives, trustees and advisors on all aspects of the law relating to older and/or vulnerable people, including children. We can assist with disabled trusts and power of attorney.
International families often call upon us to create bespoke solutions that work across jurisdictions. For example we succeeded in drafting a cross-border trust that qualifies as a disabled trust in the UK and a special needs trust in the US, holding assets in both countries.
