Withers Studio Legale

Luca is a partner in the international corporate department and global head of the sports practice.

He established his professional practice as an advisor to companies active in both national and international markets, with a particular focus on international commercial contracts and cross-border transactions.

Since 1994, he has specialised in sports marketing and sports law and provides legal advice to athletes, footballers, agents, coaches, managers, clubs, leagues, federations, investors and sponsors. He provides advice on: sponsorship contracts; playing contracts; coaching contracts; managers employment contracts; international player transfers; agency contracts; intellectual property licensing and audio-visual rights licensing. He also has long-standing experience in national and international sports regulatory issues as well as in sports commercial litigation, and in particular national and international sports arbitration.

Highlights

Over the years, Luca has been advising sports personalities and prominent clients across the whole spectrum of major sports stakeholders and different jurisdictions. Clients include Premiership, Serie A, Ligue 1, Brazilian soccer clubs, basketball clubs, leagues and other sports governing bodies, players, agents, managers and coaches as well as primary sportswear manufacturers.

Luca has been engaged by footballers and coaches such as Zlatan Ibrahimović, Pavel Nedvěd, Alexandre Pato, Fabio Borini, Mario Gómez, Roberto Donadoni, Alberto Zaccheroni, Andrea Mandorlini, Roy Hodgson and he currently acts as global legal counsel to Novak Djokovic.

Amongst his corporate clients, Luca is general counsel to Santa Margherita, one of the leading Italian wine groups; Arena, one of the largest global swimwear producers; and Gruppo Umana, leader in the industry of staff leasing services.
 

Publications and speaking engagements

Luca has published numerous articles on sports law in various publications in Italy, England, the Netherlands, Switzerland and Sweden and is a contributor to International Sports Law and Taxation Review, a member of the Editorial Board of World Sports Law Report and a co-author of the books: Sportlervermittlung & sportlermanagement (Stämfly – Beck, Mainz); Sports Image Rights in Europe, Player’s Agents Worldwide – Legal Aspects and TV Rights and Sport – Legal Aspects (all published by T.M.C. Asser Instituut, The Hague).

He has been a speaker in numerous international conferences on broadcasting rights, competition law, status and transfer of players, image rights, players contracts, sponsorships; he was lecturer at the University of Genoa, University of Padua, University of Milan and the University of Munster. He is also a lecturer of the Master in Strategies for the sports business course organised by Verde Sport S.p.A. (Benetton Group).
