Claire specialises in employment law, acting for both employers and employees. She focuses on contractual disputes, unfair and wrongful dismissal, discrimination, whistleblowing, post termination restrictions and confidentiality issues (drafting and enforcement), negotiating and drafting employment documents (including contracts of employment, handbooks and company policies) and the negotiation and settlement of severance packages.

Claire has considerable expertise in shareholder disputes, particularly where employment and shareholder issues are linked. 

As an Italian speaker, Claire also advises Italian companies, their UK subsidiaries and employees on the whole range of employment law issues. 

Highlights

• Croly v Good & others [2010] EWHC 1 (Ch) acting for the successful Petitioner where he alleged that the affairs of the company had been conducted in a manner that was unfairly prejudicial to him, entitling him to relief under s.994 Companies Act 2006.

Recent work

• Acting for an Italian company in relation to a claim under the Commercial Agents Regulations 1993.    
• Acting for two minority shareholders who were senior executives and directors in the company, excluded from Board meetings and the day to day management of the business. Successfully negotiated a severance package for both shareholders on the basis of unfair prejudice.
• Advising a Swiss company on the closure of its UK operations, redundancy of staff and the TUPE transfer of remaining employees to a German subsidiary.
• Advising a London based broking house on its conversion to an LLP and on related employment and partnership issues.
• Acting for Defendants in High Court proceedings, defending allegations of misuse of confidential information.
• Acting for the Respondent (the UK subsidiary of an Italian company) in tribunal proceedings, defending claims of sex discrimination and unfair dismissal.
• Acting for the Claimant in proceedings against a Plc alleging disability discrimination and unfair dismissal.
