Understanding trust, wills and probate mediation in the UK

Disputes, whether they are personal or professional, are often complex and can involve a great deal of emotion.
Mediation can help parties address their dispute quickly, economically and with a greater understanding of the views of the other parties. Not only does mediation offer a wide range of solutions that aren’t presented when disputes go to Court, but amicable resolution is often reached between the parties involved.
[In mediation] Everybody can get something that they consider fair, it doesn’t have to be all to one and nothing for others. It’s a much more fluid, creative, imaginative and – hopefully – emotionally attuned way of finding a solution
In this podcast*, Dawn Goodman (our own CEDR accredited mediator and trust, estate and succession dispute specialist), Lauren McGuirl (director of commercial disputes services at CEDR) and Nick Pearson (CEDR chambers mediator) explore the role of mediation in trust, wills and probate disputes, some of the common challenges and how mediation can be a useful mechanism to help resolve these disputes. Finally, they discuss some practical considerations for lawyers and practicing mediators.
