Swiss succession planning

Making a will is an essential step in ensuring that your assets are distributed according to your wishes when you die.  A will can provide clarity and guidance to your loved ones, reducing the potential for disputes and safeguarding your family’s future.  It can also save tax and mitigate issues that arise in a cross border-context.

Wills are particularly important for British nationals living in Switzerland. Switzerland’s succession laws differ significantly from those of the UK. Whereas the UK allows you to leave your estate to whomever you choose, Switzerland mandates that a portion of your estate must go to specified family members. This is known as ‘forced heirship’, and the outcome may or may not align with your wishes.

Unless the process is made easy and affordable, making a Will can remain forever on the ‘to do’ list. 
With this in mind, we have drawn on the knowledge and experience of our award-winning team of lawyers in Geneva to develop an English Will package designed for British nationals living in Switzerland. 
 

If this package is suitable for you, for a fixed fee we will prepare a Will which leaves your worldwide estate to your spouse and then to your children and descendants. We can also prepare a mirror Will for your spouse. 

This Will will include special provisions electing for English law to apply, overriding Swiss forced heirship rules. For good measure, we will also obtain formal sign-off from a Swiss attorney confirming that the Will is valid and effective in Switzerland. The Swiss attorney’s fees are not included, but we will agree them with you in advance.
