As leading specialists in international arbitration and public international law, we are delighted to partner with the British Institute of International and Comparative Law (BIICL) on their new research project, Sovereign Wealth Funds and Dispute Resolution, to analyse and explore dispute resolution trends and practices of sovereign wealth funds.
As sovereign wealth funds are major actors in the global economy, the research project will examine their trends and practices in the area of dispute resolution.
The research project will include quantitative and qualitative analysis of sovereign wealth funds' approaches to dispute resolution, including the use of international arbitration (commercial and investment treaty), recourse to domestic courts and issues of enforcement.
The research team will work until December 2020 and the results of the project will be included in a report and presented at a final conference hosted by BIICL and Withers in early 2021.
The project is led by Professor Yarik Kryvoy from the British Institute of International and Comparative Law and Hussein Haeri, partner and co-head of Withers' International Arbitration Group, and also includes Dr. Aniruddha Rajput, consultant and Member of the UN International Law Committee. Withers is uniquely placed to partner with BIICL on this project, with a preeminent public international law and investor-State arbitration practice representing sovereign States, State-owned entities and commercial parties. Our practice also includes particular experience as counsel in litigation on issues of State / sovereign immunity.
