Intellectual property

Whether you are a rapidly expanding technology business, a luxury fashion brand, a leading pharmaceutical manufacturer or a talented individual in the world of sports, art or entertainment, you cannot afford to neglect your intellectual property rights – which is where our IP lawyers can help.

In today’s highly competitive global market, identifying these rights and controlling their exploitation and protection can be the difference between success and failure. Our intellectual property attorneys advise on every stage of the development and life cycle of rights such as patents, copyright, trademarks and database and design rights – from creation to enforcement.

Intellectual Property attorneys that understand your world

What sets our intellectual property lawyers apart is their understanding of the world in which you operate. A number of our team have spent time working as in-house counsel across a broad range of industries and sectors. Our collective ‘hands on’ experience positions us to better understand client businesses, and it is a point of pride for us to act as part of your team.

As an international IP law firm, our global network allows us to partner with colleagues in countries around the world to protect your rights and we have a strong record across the US, Europe and Asia Pacific. Our multilingual team of intellectual property lawyers spans all major time zones.

Working with new and established brands

Whether you need to devise a suitable protection strategy on your expanding IP portfolio or need to resolve a multi-jurisdictional dispute, we can help. Our intellectual property solicitors work with many major luxury brands such as Renault F1, Soho House, Cowshed, Valentino and Vivienne Westwood, but also businesses that are just starting out. We advise charities, artists and galleries, tech companies, high-profile individuals and families looking to protect their brand and IP assets.

We have extensive experience of dealing with IP as part of a wider commercial transaction and arranging tax-efficient licensing and exploitation as a stand-alone service. And we regularly advise on IP rights in relation to the estates of well-known individuals and creative people.

We needed a legal advisor that could go beyond sound legal knowledge to understand our brand culture and the way in which we engage with our customers. The team took the time to get to know us and this has informed their advice on protecting our trade marks, website and mobile app.

How the intellectual property team can help

Track record

DieselReboot by Diesel

Withers is proud to have represented global Italian retailer Diesel during the launch of their reinventive new brand DieselReboot. During the launch, Withers worked alongside Diesel's newly appointed artistic director Nicola Formichetti and advised on the brand's new aims to 'rediscover and reactive the DNA of Diesel'.

Jürgen Klopp

Withers has a strong track record in representing high-profile and high-net-worth figures in the world of sport. When leading football manager Jürgen Klopp was approached by Liverpool Football Club to become its manager, we represented him in the negotiations for his move and the extension to his contract.

LG Electronics Inc

Our Singapore team successfully acted for LG Electronics Inc. in a trade mark opposition filed by headphones manufacturer Beats Electronics, LLC against the registration of the mark 'QuadBeat' before the Intellectual Property Office of Singapore, securing a favourable decision.

Camera della Moda

Camera della Moda is a non-profit organisation specialising in the promotion and support of the Italian fashion industry and young designers. The organization was challenged about the domain name for their website, and we successfully defended this allowing them to carry on building their online profile. Withers have a long-standing relationship with Camera della Moda, and together we help to support them in brand protection and the IP of the brands they represent.

A Singaporean company

Our global reach is particularly helpful to us when acting for clients with international interests, as when we helped a Singapore-based client to enforce its intellectual property rights in the Netherlands. Our client had been subject to false allegations by its Dutch counterpart of IP infringement, which we were able to refute.

A leading Italian company

We acted for a leading manufacturer of explosives and specialty chemicals in a long-running dispute over the design rights to multiple warhead systems. In an unusual case, the court had to assess the impact of the alleged infringers’ mental capacity when deciding whether their alleged acts amounted to infringement under the law.

Licensing of a new pharmaceutical drug product

Acted for an international pharmaceutical company in an evaluation project for the licensing of a new drug product as well as intellectual property litigation matters.

French fashion house

We assisted the Italian subsidiary of a renowned French fashion house in relation to the management of their brand under new Patent Box regulations

International beer manufacturer

Advised an international beer manufacturer on trademark infringement in Singapore.

Italian wine manufacturer

Managed the trademark portfolio of a leading Italian wine manufacturer.

Trademark injunction

Obtaining a unique form of injunction in relation to a claim for passing off, whereby the defendant was forbidden from using their own trade name because it had been coupled with our client's well-known brand.

License agreement for the opening of coffee shops in Asia

Assisted a HNWI who wishes to launch two new businesses in Asia. Our counterparties are an Italian company that produces and sells coffee capsules and an Italian luxury fashion brand. In cooperation with our office in Singapore, we are assisting our client in the conclusion of a licence agreement for the opening of the coffee shops and the creation of the related business concept in Asia.

Arranging design development contracts for hotels and concept stores

Assisted one of the world's most famous manufacturers and designers of hyper cars with arranging design development contracts for hotels and concept stores in collaboration with a well-known Italian architectural firm as the client wishes to expand into new markets such as interior design.

Contractual agreement and privacy issues involved in opening a hotel in Rome

Assisted Ennismore, a hotel group that develops, operates and curates unique hospitality properties and experiences around the world (including The Hoxton, a group of open-house hotels around the world), with the contractual agreement and privacy issues involved in opening a hotel in Rome.

Privacy compliance

Assisted Fanuc Italia, a multinational leader in the design and manufacture of robotics and automated assembly lines, with ongoing advice in relation to privacy compliance. Our advice impacted on their relationship with their head office as well as with their suppliers and clients.

Right to use particular images for marketing purposes

Advised a company which produces devices that assist with posture and helps stabilise people with disabilities as well as the elderly, on the use of images of disabled minors for a marketing project. The legal aspects of the situation were particularly delicate because we had to identify the correct balance between the wellbeing of the minors, especially when the images evidenced the fact that they were disabled.

Contractual agreements between e-commerce seller and their suppliers

Advised a luxury homemade furniture and décor seller on their contractual agreements with the designers and artisans who sell their work on the client's e-commerce platform. Our client's offer to their suppliers is innovative: they receive a package of additional services including marketing, digital promotion and analytics which differs considerably from the normal services provided by their competitors.
