The ability to protect confidential information through non-disclosure agreements (NDAs) is a valuable tool for employers and can be used to protect both business secrets and other sensitive information. In recent years, however, there has been a focus on NDAs potentially being misused to cover up wrongdoing. Successive calls for NDAs to be banned have not yet come to fruition, but have resulted in intense scrutiny by regulators and legislative measures placing restrictions on the way NDAs are used. Further restrictions are expected to be included in the Employment Rights Bill.

In this online masterclass, members of our employment team, Libby Payne, Hugh More and Kyle Hefford will explore both the current framework governing and limiting the use of NDAs, and the proposed changes in the law. They will look at points to consider when thinking about whether to use an NDA at all and the potential pros and cons of various approaches. Joined by Jo Sanders, partner in our media and reputation team, they will also look at the measures needed to make an NDA as enforceable as possible and some of the data protection and privacy issues they give rise to.
