Relocation applications
Acting for the father in successfully resisting the mother's application for sole care and control and leave to relocate with the children to Australia. At first instance, the Family Court found in favour of the father, granting him sole care and control and dismissing the mother's prayer for relocation. On appeal, the Family Division of the High Court dismissed the mother's appeal, finding that the close bond between the father and the children weighed against relocation and that in view of the mother's immigration status in Singapore the father should have sole care and control. Disclosure applications
Acting for the wife in her application for discovery and interrogatories to successfully obtain an order for disclosure of the husband’s personal bank statements and those of the private limited company of which he was a director. The Court also ordered the husband to pay a significant sum of costs to the wife for the application, in view of his habitually dilatory conduct in the proceedings. Reported Judgement in XBI v XBJ [2024] SGFC 66.
Division of assets
Acting for the wife in the parties’ cross-appeals to the Family Division of the High Court in relation to the orders for division of assets, child maintenance and spousal maintenance. Successfully argued for the appellate Court to overturn the lower Court’s decision as to the consequential orders for the division of assets, on the basis that the global assessment methodology was the correct approach. This resulted in the Court ordering the husband to pay the wife a sum amounting to an additional 6% of the pool of matrimonial assets. Reported Judgement in WSY v WSX and another appeal [2024] SGHCF 21.
Jurisdictional challenges
Acting for the husband in his application to stay the ancillary matters proceedings in Singapore, pending the determination of this issue before the Courts in Israel. This involved novel issues of law, in terms of whether there may be a bifurcation of the divorce proceedings and the ancillary matters, and whether the Singapore Court is entitled to order a partial stay of proceedings. The Court also considered the relevance of the Anti-Suit Injunction made by the Israeli Court, and its bearing on international comity. Reported Judgement in XFS v XFT [2025] SGFC 1.
Mediation and negotiation
Imogen has acted for various clients in child-focused mediations and negotiations to resolve the issues concerning the children to the marriage as well as spousal maintenance and division of assets. Imogen has successfully assisted parties to reach an agreement to resolve matters amicably without undergoing the litigated process.
